Welcome to Vogune. By visiting our website or placing an order, you agree to these Terms of Service. We recommend reading them before making a purchase. If you do not agree, please do not use our website or services.

In these Terms of Service, the following definitions apply. "We", "us" and "our" refer to Jansen Sales en Marketing. "You" refers to the user or customer of our website. "Site" refers to vogune.com. "Services" refers to all products, features and functionality offered through our site.

Section 2 – About Us

Vogune is an online fashion store operated by Jansen Sales en Marketing, a legally registered business in the Netherlands. Although our company is based in the Netherlands, Vogune has been created specifically for customers in the United States. Our store runs on the Shopify platform.

Section 3 – Age and Eligibility

By using our site, you confirm that you are at least 18 years of age or have the permission of a parent or legal guardian. Our store is intended for personal, non-commercial use only. Commercial resale of our products without written consent is prohibited. We reserve the right to refuse service to anyone at any time and for any reason.

Section 4 – Orders

When you place an order, you are making an offer to purchase. We send you an order confirmation email, but this does not constitute final acceptance. Your order is only accepted once it has been shipped and you receive a shipping confirmation. We reserve the right to refuse or cancel any order at our discretion, including cases of suspected fraud, incorrect information or stock issues. If we cancel your order, you will receive a full refund.

Section 5 – Cancellations

If you need to cancel your order, contact us as soon as possible at support@vogune.com. We will do our best to accommodate your request, but we cannot guarantee cancellation once an order has been submitted for processing. If your order has already shipped, our Return & Refund Policy applies.

Section 6 – Products and Pricing

We make every effort to display our products as accurately as possible, but colors may vary depending on your screen settings. We do not guarantee that all product descriptions are completely free of errors. Prices are subject to change without notice. In the event of a clear pricing error, we reserve the right to cancel the order and notify you. We also reserve the right to limit sales of products to certain regions or individuals.

Section 7 – Payment

We accept Shop Pay, Google Pay, Apple Pay, Visa, Mastercard and Maestro. All payments are processed securely through our payment partners. By entering your payment information, you confirm that you are authorized to use the payment method provided. We never store your complete payment details on our servers. We are not responsible for any additional fees charged by your bank or payment provider.

Section 8 – Shipping and Delivery

Full shipping and delivery information is available in our Shipping Policy on the site. We are not liable for delays caused by third parties, customs or circumstances beyond our control. Once a package has been handed to the carrier, risk transfers to the carrier. If your package is lost in transit, please contact us at support@vogune.com.

Section 9 – Returns and Refunds

Our full Return & Refund Policy is available on the site. By placing an order, you agree to this policy. Returns are only accepted with our prior written approval. We will process refunds within 7 business days of receiving and inspecting the returned item.

Section 10 – Accuracy of Information

We strive to keep the content on our site accurate and up to date, but we cannot guarantee that all information is complete, correct or current. The content is provided for general informational purposes only. We reserve the right to modify the content of our site at any time without notice. Any decisions made based on information on our site are entirely at your own risk.

All content on vogune.com, including but not limited to text, images, logos and graphics, is the exclusive property of Vogune or its suppliers and is protected by copyright and other intellectual property laws. You may not copy, distribute, modify or use this content without our prior written permission.

Section 12 – Prohibited Use

You may not use our site for any unlawful purpose, to solicit others to perform illegal acts, to infringe on intellectual property rights, to harass or discriminate against other users, to submit false or misleading information, to distribute viruses or malicious software, to collect personal data from other users, to conduct spam or phishing activities, or to attempt to bypass our security systems. Violations may result in immediate suspension of your access without notice.

Section 13 – User Comments and Feedback

If you submit reviews, suggestions, feedback or other content to us through our site, email or any other channel, you grant us the right to use, publish and distribute that content without restriction or compensation. We are not obligated to treat submissions as confidential or to respond to them. We reserve the right to remove any content we consider inappropriate, unlawful or misleading. These Terms remain in effect until terminated by you or by us. You may terminate at any time by stopping your use of our site. If you violate any provision of these Terms, we may suspend or terminate your access without notice. All obligations incurred prior to termination will survive.

Section 22 – Entire Agreement

These Terms of Service, together with our Privacy Policy, Shipping Policy and Return & Refund Policy, constitute the entire agreement between you and us regarding your use of our site. Our failure to enforce any provision of these Terms does not constitute a waiver of our rights.

Section 23 – Governing Law

These Terms are governed by the laws of the Netherlands. Any disputes arising from these Terms or your use of our site will first be attempted to be resolved through good-faith negotiation. If a resolution cannot be reached, disputes shall be subject to the jurisdiction of the competent courts of the Netherlands. As a business based in the EU, we also comply with applicable consumer protection laws in the United States.

Section 24 – CESOP Compliance

From 2024, payment service providers register transaction data in the CESOP system in accordance with EU regulations. Vogune complies with these regulations, which may have consequences for the tracking and reporting of payments.

Section 25 – Changes to These Terms

We may update these Terms from time to time. The most recent version will always be available on our site. By continuing to use our site after any changes are made, you accept the updated Terms. We recommend checking this page periodically.
